Terms of service

These terms cover your use of DataFromChart ("the Service") at datafromchart.com, operated by DataFromChart ("we", "us"). By using the Service you agree to these terms. If you don't agree, please don't use it.

Our Privacy policy is part of these terms.

1. Your account

You can try DataFromChart without an account using the built-in sample charts. To upload your own chart images or PDFs, or to access premium features as they become available, you'll need to create one.

You're responsible for keeping your account secure. Don't share your sign-in link with anyone, and let us know straight away if you think your account has been compromised. You must be at least 13 years old to create an account.

2. Acceptable use

Don't use DataFromChart to:

• Break any law or infringe anyone's rights.
• Upload content you don't have the right to use.
• Reverse-engineer, scrape, or attempt to extract our source code, or build a competing product directly from it.
• Abuse, overload, or interfere with the Service (including bypassing rate limits or security controls).
• Upload malware, run automated abuse, or impersonate anyone.

We can suspend or terminate accounts that breach these rules.

3. Your content

Anything you upload — chart images, extracted data, feedback — stays yours. By using the Service, you grant us a limited licence to process that content as needed to provide the Service (sending images to your chosen AI provider for extraction when you use AI features, displaying things back to you, and so on).

We may also use uploaded content in de-identified or aggregated form to evaluate and improve our extraction quality and the underlying models we build or fine-tune. We don't sell your content, and we don't share identifiable uploads with third parties for their own training purposes.

You're responsible for making sure you have the right to upload what you upload, and for the accuracy of any data you extract or rely on.

4. The Service is provided as-is

We work to keep DataFromChart reliable and accurate, but extraction results — especially from AI features — can be wrong, incomplete, or out of date. Always sanity-check anything important against the original source. You use the Service at your own risk.

We may add, change, suspend, or remove features at any time. We may also do scheduled or emergency maintenance that temporarily makes the Service unavailable.

5. Free and paid plans

DataFromChart offers a free tier, including unlimited manual chart extraction. AI auto-extraction uses credits: every account gets a few free, and more can be bought as one-time credit packs. Purchased credits never expire and are non-refundable except where required by law. Payments are processed by Stripe.

(a) Prices and changes

Pack prices and what each pack includes are shown on our pricing page. We can change them at any time; any change applies only to future purchases and never retroactively to credits you've already bought.

(b) One-time purchases

Credit packs are one-time purchases. There is no subscription and no recurring or automatically renewing charge — you pay once per pack, the credits are added to your account, and they never expire. Payments are processed by Stripe.

(c) Refunds

Payments are non-refundable except where required by law. If something's gone wrong — a duplicate charge, a clear technical fault — email us and we'll sort it out.

(d) Taxes

Prices may exclude applicable taxes (GST, VAT, sales tax). You're responsible for any taxes other than those on our net income.

6. Our intellectual property

The Service — including the site, the app, our code, designs, and content we publish — is owned by us or our licensors and protected by intellectual-property law. These terms don't transfer any of that to you. You may use the Service for its intended purpose; you may not copy, redistribute, or build a derivative product from it.

7. Third-party services

The Service relies on third-party providers (for hosting, auth, email, analytics, AI, and payments). We don't control those services and we're not responsible for their content, availability, or practices. When you use a feature that involves a third party — for example, AI extraction — that provider's own terms apply alongside ours.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or that any results from it (especially AI-generated results) will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, DataFromChart, its directors, and employees won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of business, arising out of your use of the Service.

Where liability can't be excluded by law, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.

10. Indemnification

You agree to indemnify us against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the Service, or your violation of any law or third-party rights.

11. Termination

You can stop using the Service or delete your account at any time. We can suspend or terminate your access if you breach these terms or if we have a good reason to (security, legal, abuse). Sections that by their nature should survive — IP, disclaimers, liability, indemnification, governing law — survive termination.

12. Governing law

These terms are governed by the laws of Australia, except where applicable consumer law gives you a non-waivable right that says otherwise.

13. Changes to these terms

We may update these terms from time to time. If the changes are material we'll update the date at the top and, where appropriate, let you know in-app or by email. Continuing to use the Service after a change means you accept the new terms.
